Cultural Agreement Between the Government of the German Democratic Republic and the Government of the People's Republic of China
The Government of the German Democratic Republic and the Government of the
People's Republic of China (hereinafter referred to as "the Contracting
Parties"), in accordance with principles of equality of sovereignty, no
interfering in the other Party's interior affairs, mutual respect and mutual
benefit, and with a view to strengthening friendly relations and cooperation
between the two countries, encouraging mutual understanding for each other's
culture and between their people via cooperation in the sphere of culture and
science, and enhancing the two countries' socialist construction and the world's
peace and security, have decided to conclude the present Agreement, the
provisions of which are as follows:
Article 1
The Contracting Parties shall encourage and promote exchanges and cooperation
in the fields of culture, art, education, science, public health, social
welfare, sports, the press, broadcasting, television, cinema, publication and
tourism.
Article 2
The Contracting Parties shall encourage and support cooperation in the fields
of science and research, and exchanges of delegations, specialized books,
experiences, materials, and science activities. The two Parties shall encourage
the establishment of direct relations based on relevant special agreements
between China Academy of Sciences, China Academy of Social Sciences, Science
Academy of the German Democratic Republic, and other science institutions of the
two countries.
Article 3
The Contracting Parties shall encourage and support cooperation and exchanges
in the fields of higher education, national education and profession training,
reciprocal visits of delegations, scientists, college teachers and young
scientists for lecturing, advanced studying and academic meetings, and exchange
of specialized books and teaching materials.
The Contracting Parties shall encourage and support the exchange of
undergraduates and postgraduates for training, advanced learning and
professional training in the other Party's colleges, institutions, technological
academies and other research institutions, relevant agreements of which shall be
agreed on separately.
The Contracting Parties, on the basis of their needs and possibilities, shall
encourage the establishment of direct relations between colleges, institutes and
other educational organizations.
Article 4
The Contracting Parties shall examine and acknowledge their respective
requirements for educational background, diploma, degree and professional title
of colleges and institutions of higher learning, based on which a relevant
special agreement can be drawn.
Article 5
The Contracting Parties shall encourage and support studies and researches on
the other Party's language, literature and culture, etc. For this purpose, the
two Parties shall encourage the exchange of lectures, teachers and scientists
between colleges, academies and research institutes of the two countries.
The Contracting Parties shall encourage each other to include in their
respective textbooks and other publications materials about the other Party's
country.
Article 6
The Contracting Parties shall encourage and facilitate the following
exchanges and cooperation in the sphere of culture and art:
(a) Reciprocal visits, study, training and advanced learning of writers,
artists and cultural staff, as well as attendance at art festivals, competitions
and other cultural activities; (b) Exchange of performing tours by troupes of
artists; (c) Exchange of art and other exhibitions; (d) Reciprocal shows
of features and other films, as well as opera and musical performances of the
other Party; (e) Translation and publication of outstanding works of
literature, art and science of each other's country, and hence cooperation in
these fields; (f) Promotion of friendly relations between cultural
institutions and various associations.
Article 7
The Contracting Parties shall encourage and support cooperation and exchanges
between museums, libraries and cultural relics preservation organizations, and
the exchange of specialized magazines, books and other materials.
Article 8
The Contracting Parties shall encourage and support cooperation and exchanges
in the fields of public health and social welfare, exchange of delegations,
scientists, experts, doctors, and medical staff for reciprocal visits, study and
advanced learning tours, medical science activities and exchange of experiences,
and exchange of information and publications. For this purpose, the Parties
encourage the sign of single agreements.
Article 9
The Contracting Parties agree to promote cooperation in the field of sports,
specific measure of which shall be agreed on separately by sports supervisory
authorities of the two Parties.
Article 10
The Contracting Parties shall encourage and support exchanges and cooperation
in the fields of broadcasting, television, news agencies, newspapers and
journalist associations.
The Contracting Parties shall encourage activities and reports on politics,
economy, culture and sciences, as well as development of the other Party's
country by their permanent and temporary reporters dispatched to the country.
The Parties encourage their relevant supervisory authorities to sign a
special agreement on this respect.
Article 11
The Contracting Parties shall encourage and support cooperation in the field
of tourism, especially group tours and juvenile tours.
Article 12
The Contracting Parties shall encourage activities between the Chinese
People's Associations for Friendship with Foreign Countries and People's
Associations for Friendship with Foreign Countries of the German Democratic
Republic, for the purpose of better understanding and friendship between people
of the two countries.
Article 13
The Contracting Parties shall encourage their relevant supervisory
authorities to inform each other of various Agreement-related and mutually
interested international meetings held in the Republic of China and the German
Democratic Republic.
Article 14
The Contracting Parties shall encourage cooperation within the confines of
this Agreement, international pacts valid to both Parties, and international
organizations in which both Parties are members.
The Parties shall encourage cooperation between respective UNESCO committees
of the two countries.
Article 15
Citizens of the Republic of China and the German Democratic Republic sent to
implement the above agreements shall have the liability to obey the receiving
country's laws and regulations. Each of the two Contracting Parties shall
endeavor to provide necessary conditions to citizens dispatched by the other
Party to implementing the above agreements, including admission to scientific
and cultural establishments, archives, and libraries.
Citizens of two Parties dispatched to implement this Agreement, when falling
ill, shall get free medical treatment in the country they are sent to.
Article 16
With a view to implementing the present Agreement, the Contracting Parties
shall reach an agreement on executive programs including specific measures,
conditions and fiscal provisions for cultural and scientific exchanges.
Negotiations concerning this respect shall be held in turn in Beijing and
Berlin.
Scientific and technical cooperation and other economic issues shall not be
included in this Agreement.
Article 17
This Agreement shall remain valid for a period of five (5) years. Thereafter
it shall be automatically renewed for successive periods of five (5) years
unless either Contracting Party requests its termination by written notice to
the other served at least six (6) months prior to the date of expiration.
The Contracting Parties shall reach a written agreement if modification and
amendment of this Agreement is needed.
Article 18
This Agreement shall enter into force on the date of signature. Once it is
signed, the cultural cooperation agreement previously signed by the Republic of
China and the German Democratic Republic on December 25th, 1955, shall be
terminated at once.
Done in Beijing on May 10th, 1984. In duplicate in Chinese and German
languages, both texts being equally authentic.
